Terms of Use for DaDesktop Public Cloud

Purpose

The remote desktops provided are intended exclusively for delivering courses, consultancy services, or recruitment.

Non-permitted use

The following activities are not allowed:

  1. Hosting websites or other services
  2. Bitcoin mining
  3. Performing performance testing

If our staff detects any of these activities, the service will be terminated immediately, and no refund will be provided.

 

Guarantee and Service Level Agreement

DaDesktop ensures 95% availability of the service.

Maintenance, repairs, and upgrades will be carried out outside of the hosted working hours, from 8 a.m. to 8 p.m. local server time (based on the physical location of the server).

 

Data Safety and Confidentiality

This service is provided on an as-is basis, and DaDesktop cannot guarantee the safety or confidentiality of data copied to the desktops. If you require such guarantees, we recommend using DaDesktop On-Premise instead.

Since the desktops are mainly designed for training, they are not suitable for handling highly sensitive material.

Authentication to the Remote Desktops is built for ease of use, not as a security measure.

Troubleshooting Recording

For troubleshooting purposes, Course Desktops—including Fresh-start, Trainer, and Participant desktops—may be recorded.

Disclaimers of Liability – Indemnification

DaDesktop provides the services on an ‘as is’ and ‘as available’ basis, with all faults. Neither we nor our suppliers make any express or implied warranties about the services. To the fullest extent permitted by law, we and our suppliers disclaim all implied warranties, including merchantability, satisfactory quality, accuracy, fitness for a particular purpose, and non-infringement. We do not guarantee that any results obtained from using the services will be effective, reliable, accurate, or meet your requirements. We also do not guarantee that you will be able to access or use the services (either directly or via third-party networks) at times or locations of your choosing. No oral or written information from a DaDesktop representative will create a warranty. You may have additional consumer rights under your local laws that this contract cannot override. You use the services at your own risk.

Your sole and exclusive remedy for any dispute with us or our suppliers is the cancellation of your account. In no event shall our, our affiliates’, and our suppliers’ aggregate and cumulative liability to you for any claims related to your use of the services exceed the total amount of fees, if any, that you paid during the period in which those claims arose. We, our affiliates, and our suppliers shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of or inability.
